These terms and conditions (the “Terms and Conditions”) shall apply to and govern any nomination submitted to World Rugby Limited (“us” or “World Rugby”) in connection with the World Rugby 2018 Spirit of Rugby Award in association with Dove Men+Care (the “Award”) and the process by which World Rugby reviews and assesses such nominations and the Award winner is selected (the “Nomination Process”).

The Award champions an individual moment of sportsmanship or care by a term or player at grassroots or elite level (male or female). These moments can occur on the field of play or extend to life beyond the rugby field. Award nominations should relate to a moment that can be easily captures in a snapshot. Examples include a player handing over a finals medal to a fan, an unplanned sporting gesture from one player/team to the opposition, a player/team who supported or gave a fan an unexpected opportunity of a lifetime, a team that has gone above and beyond an individual in need, etc.

By submitting a nomination for the Award, you confirm that you have read and agree and accept these Terms and Conditions.

IMPORTANT NOTICE REGARDING PERSONAL INFORMATION: Please note that we need to collect and process personal information relating to you and each individual you nominate in connection with the Nomination Process and the Award. Before submitting any nomination, please ensure that you review the Personal Information Notice and that you and any individuals you are nominating for the Award are aware of how your personal information will be used by us in connection with the Nomination Process and the Award. 

  1. When submitting your nomination, you must confirm that you have obtained the consent of the individual(s) whose personal information you are submitted in your nomination (or, where appropriate, the consent of the guardian(s) of such individuals(s)) to the submission of their personal information to us in connection with their nomination for the Award. 
  1. The Award champions an individual moment of sportsmanship or care by a term or player at grassroots or elite level (male or female). These moments can occur on the field of play or extend to life beyond the rugby field. Award nominations should relate to a moment that can be easily captures in a snapshot. Examples include: 

a. a player handing over a finals medal to a fan;

b. an unplanned sporting gesture from one player/team to the opposition;

c. a player/team who supported or gave a fan an unexpected opportunity of a lifetime; and

d. a team that has gone above and beyond an individual in need. 

  1. There is no charge for submitting a nomination, and there is no limit to the number of nominations that can be submitted. However, a separate nomination should be completed and submitted for each nomination you wish to submit. You are not excluded from nominating yourself for the Award. 
  1. All individuals nominated for the Award by you must, on the date of your nomination, be at least 16 years of age. The Award will not be awarded to any individual under 16 years of age and nominations for individuals under that age should not be submitted and will not be considered or accepted. 
  1. All nominations must be submitted to World Rugby via the official online nomination form at https://www.worldrugby.org/awards/spirit-of-rugby. In order to successfully submit a nomination, all required fields in the official online nomination form must be completed. We reserve the right to reject or exclude from consideration for the Award any nomination submitted to us via any other method or any nomination which is incomplete or missing required information. 
  1. You are encouraged to include as much information as possible in the nomination (including, where appropriate, images and videos), within the relevant limits that apply on the official online nomination form, to assist the review and consideration of each nomination by the Panel. 
  1. By submitting a nomination, you represent and warrant to World Rugby that all information included in such nomination is accurate and not misleading, contains no material errors or omissions, has been submitted in good faith by you, and will not expose World Rugby to any civil or criminal liability or otherwise materially adversely affect World Rugby’s business or reputation. You further represent and warrant to World Rugby that you have the right to submit all such information to us for the purposes set out in these Terms and Conditions without infringing any applicable laws or any rights of any third parties. You hereby indemnify World Rugby against any losses, claims, actions or demands, liabilities or expenses incurred or suffered by World Rugby as a result of any breach of the foregoing representations and warranties. 
  1. By submitting any video or images with your nomination, you thereby grant World Rugby a royalty-free, non-exclusive, irrevocable, sub-licensable and transferable right and licence to use, reproduce, modify, adapt, translate, create derivative works from, publish, distribute, broadcast, transmit, communicate to the public, perform, play, and exercise all copyright, database rights, publicity rights and other intellectual property rights with respect to any such video or image content worldwide and/or to incorporate it in other works in any media now known or hereinafter developed for the purposes of reviewing and assessing your nomination, editing, generating, preparing and/or distributing any content for publication in connection with the submission of your nomination to the public voting process and/or any content relating to the publication or promotion of the Award or Award winner or nominees. 
  1. All nominations must be submitted by no later than 12:00 GMT Monday 15 October. We reserve the right to reject or exclude from consideration for the Award any nomination submitted to us after that time. 
  1. After expiry of the deadline, all validly completed and submitted nominations will be reviewed and assessed by a panel consisting of representatives of World Rugby, Dove Men+Care and the UK Telegraph Newspaper (the “Panel”). 
  1. Without prejudice to the provisions of paragraph 6 above, we reserve the right to take steps to verify the accuracy of any information contained in any nomination as part of the assessment of each nomination by the Panel in accordance with these Terms and Conditions. 
  1. Having reviewed all validly completed and submitted nominations, the Panel will select a shortlist of nominees for public vote. In selecting the shortlist, the Panel will have regard to the overall Spirit of Rugby and the criteria set out in paragraph 2 above. While categories of nominees are requested at the time a nomination is submitted, the Panel is not required to include a nominee from each category in the public vote shortlist. 
  1. The decision of the Panel with respect to the shortlist is final and no correspondence or discussion will be entered into or feedback given regarding the selection of shortlisted nominations. You have no right to an explanation as to why any nomination submitted by you was or was not included on the shortlist. 
  1. Nominees included in the public vote shortlist will be contacted by us in advance of opening the public vote period to re-confirm that they are happy to be included in the public vote process. If any nominee withdraws their consent to be included in the public vote process, they will forego the opportunity to win the Award and may be replaced in the public vote process by another nomination selected by the Panel. 
  1. Once the public vote shortlist has been selected, details of each shortlisted nomination will be published along with a mechanism for enabling members of the public to vote on their preferred nominee. 
  1. The public vote period will last for one (1) week. The winner of the Award will be the shortlisted nomination which receives the highest number of votes during the public vote period, as counted and determined by World Rugby. Members of the public may not vote more than once during the public vote period. 
  1. You agree that you will not, and will ensure that your nominees will not, engage in or carry on any concerted effort to distort the outcome or conduct of public voting process (but, for the avoidance of doubt, encouraging other members of the public to vote for a particular shortlisted nomination shall not be considered to be a breach of these Terms and Conditions). World Rugby reserves the right to exclude or disregard from the final count of votes any vote, group of votes or pattern of voting which it determines, in its absolute discretion, to constitute a concerted effort to distort the results of the public vote or otherwise distort the fairness or integrity of the public vote process. 
  1. The winner of the Award will be announced at the World Rugby Awards 2018 ceremony in Monaco on 25 November 2018
  1. The final nominees (or a representative of each nominee) will be invited to attend the World Rugby Awards 2018 ceremony in Monaco, where the winner will be announced on 25 November 2018. Nominees who are under the age of 18 years on 25 November 2018 may not attend the ceremony but may nominate a representative who is over the age of 18 years to attend the ceremony on their behalf. Dove Men+Care will cover flights, accommodation and transfers in Monaco. 
  1. The Award winner will be expected to appear on stage at the World Rugby Awards 2018 ceremony to receive the Award from a Dove Men+Care representative and the ceremony MC. The Awards winners appearance on stage will be captured on the live broadcast of the ceremony which will be distributed on World Rugby’s website and social media channels. The Award winner will also be expected, following receipt of the Award to attend the ceremony media centre for interviews and will provide interviews on request to the media and social media or digital teams of World Rugby and Dove Men+Care. Footage of the Award winner accepting the Award and any content or other clips prepared in respect of the winner’s nomination for the Award (e.g. content prepared for the public voting process or any winner’s montage). 
  1. You agree that World Rugby shall not be liable to you or any individual nominated for the Award by you under any circumstances, and that neither you nor any individual nominated for the Award by you shall have any claim against World Rugby or Dove Men+Care, in connection with the selection of the public vote shortlist by the Panel or the outcome or conduct of the public vote process. 
  1. NEITHER WORLD RUGBY, DOVE MEN+CARE NOR ANY OF THEIR RESPECTIVE AFFLIATES, EMPLOYEES, OFFICERS, DIRECTORS WILL BE LIABLE (TO THE EXTENT PERMITTED BY LAW) FOR ANY DIRECT, INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE ARISING OUT OF OUR ORGANISING OR HOLDING THIS NOMINATION PROCESS OR AS A RESULT OF YOUR SUBMISSION OF ANY NOMINATION FOR THE AWARD OR AS A RESULT OF THE FINAL DETERMINATION OF THE PUBLIC VOTING SHORTLIST OR THE AWARD WINNER, OR IF THE NOMINATION PROCESS DOES NOT RUN AS PLANNED. IF THIS NOMINATION PROCESS, THE SELECTION OF THE AWARD WINNER OR ANY PART OF THE SAME IS NOT CAPABLE OF RUNNING OR BEING COMPLETED AS PLANNED FOR ANY REASON, INCLUDING BUT NOT LIMITED TO REASONS OF INFECTION BY COMPUTER VIRUS, BUGS, TAMPERING, UNAUTHORISED INTERVENTION, TECHNICAL FAILURES OR ANY OTHER CAUSES BEYOND THE CONTROL OF WORLD RUGBY, WE RESERVE THE RIGHT TO CANCEL, TERMINATE, MODIFY OR SUSPEND THE NOMINATION PROCESS. 
  1. If any of these terms are determined to be illegal, invalid, or otherwise enforceable then the remaining terms shall continue in full force and effect. 
  1. These Terms and Conditions (and any non-contractual obligations arising out of them) shall be governed by and construed in accordance with the laws of England and Wales and the parties agree to submit to the exclusive jurisdiction of the Courts of England and Wales. 
  1. World Rugby reserves the right to amend these Terms and Conditions and/or amend or cancel the Nomination Process or the giving of the Award from time to time, and any updates to these Terms and Conditions shall be published at https://www.worldrugby.org/awards/spirit-of-rugby/tandcs
